Terms of Service - Charketplace

1 Acceptance of Terms

By accessing or using Charketplace ("the Service," "the Platform"), you agree to be legally bound by these Terms of Service and all applicable laws and regulations. If you do not agree to these terms, you must not access or use the Service.

These Terms apply to all users of the Service, including buyers, sellers, and visitors. Your continued use of the platform following any changes to these Terms constitutes acceptance of those changes.

2 Description of Service

Charketplace is a digital marketplace that connects buyers and sellers of software products including, but not limited to:

Game modifications (mods), scripts, cheats, and trainers
Tools, executors, spoofers, and DLL injectors
Plugins, themes, assets, and related digital software

Charketplace facilitates transactions between independent buyers and sellers. We are not the seller of any product listed on the platform and are not responsible for the content, quality, legality, or accuracy of listings created by sellers.

3 User Accounts

Registration: You must create an account to buy or sell on Charketplace. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
Accuracy: You agree to provide accurate, current, and complete information at registration and to keep it up to date.
Age Requirement: You must be at least 18 years old to use this Service. By creating an account, you confirm you meet this requirement.
One Account: Each person may maintain only one account. Creating duplicate accounts to circumvent bans or restrictions is prohibited.
Email Changes: Your registered email address cannot be changed through the platform. Contact support if you need to update your email.
Account Security: You must notify us immediately of any unauthorized use of your account. We are not liable for losses caused by unauthorized access resulting from your failure to secure your credentials.

4 Seller Obligations

Sellers keep 92% of every sale.
Charketplace charges an 8% platform fee, automatically deducted at payout. There are no listing fees or monthly charges.

Approval: All product listings must be submitted through the Sell a Product form and are subject to review by the Charketplace admin team before being listed publicly. Submissions may be approved or rejected at our sole discretion. Rejection notifications include a reason when provided by the reviewing admin.
Stripe Connect: Sellers must connect a valid Stripe account to receive payouts. Charketplace uses Stripe Connect to route payments directly to sellers' bank accounts. Payouts will not be processed without a connected and verified Stripe account.
Content Responsibility: Sellers are solely responsible for the accuracy, legality, and quality of their listings, including descriptions, pricing, and product files.
Pricing Models: Sellers may offer products as one-time purchases, subscriptions (weekly, monthly, quarterly, bi-annual, or yearly), or time-limited keys (1–7 days).
Product Updates: Sellers are encouraged to keep their products updated and functional. Listings with persistent quality issues or buyer complaints may be removed at our discretion.

Prohibited Listings: Sellers may not list products that:

Contain malware, spyware, ransomware, or any harmful code
Infringe on trademarks, copyrights, or other intellectual property rights
Are designed to cause harm to individuals, systems, or organizations
Are stolen, unauthorized copies, or re-listed content from other sellers
Violate any applicable local, national, or international law

5 Buyer Obligations

Final Sales: All sales are final. We do not offer refunds for digital products once delivered. Please review all product descriptions, screenshots, and seller information carefully before purchasing.
Usage Risk: Buyers acknowledge that using certain software products — such as game cheats, mods, or scripts — may violate third-party terms of service (e.g., game publishers). Buyers assume all associated risks, including account suspensions or bans.
No Redistribution: Purchased products are licensed for personal use only. Buyers may not redistribute, resell, or share access to products purchased on Charketplace.

Important: Charketplace is not responsible for consequences arising from the use of purchased products, including but not limited to game account bans, hardware bans, or violations of third-party terms of service.

6 Payment Processing

All payments are processed securely through Stripe. By making a purchase or receiving a payout, you also agree to Stripe's Terms of Service.

Charketplace does not store credit card numbers, bank account details, or any sensitive payment information on its servers. All such data is handled exclusively by Stripe's PCI-compliant infrastructure.

Seller payouts are transferred directly to the seller's connected Stripe account, subject to Stripe's standard payout schedule and any applicable holds.

7 Intellectual Property

Seller Content: Sellers retain full ownership of products they list. By submitting a listing, sellers grant Charketplace a non-exclusive, royalty-free license to display, promote, and distribute their product descriptions, images, and metadata on the platform.

Buyer License: Purchasing a product grants the buyer a personal, non-transferable, non-sublicensable license to use that product for their own personal, non-commercial use. No ownership is transferred.

Charketplace IP: The Charketplace name, logo, branding, and platform code are our exclusive property. You may not copy, reproduce, or use them without written permission.

8 Prohibited Conduct

You may not engage in any of the following:

Uploading or distributing malware, viruses, ransomware, or other harmful software
Committing or facilitating fraud, including chargebacks for received products
Harassing, threatening, or abusing other users or Charketplace staff
Attempting to bypass or circumvent payment systems or platform fees
Using automated bots, scrapers, or tools to extract data from the platform
Creating fake accounts, reviews, or testimonials
Impersonating another user, seller, or Charketplace employee
Engaging in any activity that disrupts or interferes with platform operations

Violations may result in immediate account suspension or permanent termination without notice.

9 Disclaimers

No Warranties: The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.
Compatibility: Charketplace does not guarantee that products will work with specific games, software versions, or hardware configurations, or that they will remain functional after game updates or patches.
Third-Party Risk: Using game modifications may result in account bans, hardware bans, or other consequences from game publishers or anti-cheat systems. Charketplace bears no responsibility for such outcomes.
Availability: We do not guarantee uninterrupted or error-free access to the platform. Scheduled and unscheduled maintenance may cause temporary downtime.

10 Limitation of Liability

To the maximum extent permitted by law, Charketplace and its team shall not be liable for any indirect, incidental, special, punitive, or consequential damages arising from:

Loss of data, game accounts, or in-game progress
Damages caused by defective, incompatible, or malicious products
Unauthorized access to your account or data
Decisions made by game publishers, anti-cheat providers, or platform operators
Platform downtime or service interruptions

In no event shall Charketplace's total liability exceed the amount you paid to us in the 12 months preceding the claim.

11 Termination

We reserve the right to suspend or permanently terminate your account at any time, with or without notice, if we determine that you have violated these Terms or engaged in prohibited conduct.

You may close your account at any time by contacting us through the Help page. Upon account closure:

Active product listings will be removed from the marketplace
Pending payouts will be processed to your connected Stripe account
Transaction records may be retained as required by law

Sections 7, 9, 10, 12, and 14 survive termination.

12 Dispute Resolution

We encourage you to contact us through the Help page before pursuing any formal dispute. Many issues can be resolved quickly through our support team.

For disputes between buyers and sellers, Charketplace may, at its discretion, provide mediation support but is not obligated to do so and is not a party to transactions between users.

Any legal claim arising from these Terms or your use of the Service must be brought within one (1) year of the event giving rise to the claim.

13 Changes to Terms

We may update these Terms at any time. When we do, we will update the "Last updated" date at the top of this page. For significant changes, we may notify users via email or an in-platform notice.

Your continued use of Charketplace after changes are posted constitutes your acceptance of the revised Terms.

14 Governing Law

These Terms are governed by and construed in accordance with applicable law. Any disputes arising under these Terms will be subject to the exclusive jurisdiction of the courts in the jurisdiction where Charketplace operates.
